<br />tion of any rules and regulations adopted by a
<br />public agency regarding the designation of man-
<br />agement and confidential employees of a public
<br />agency and restricting those employees from
<br />representing any employee organization that
<br />represents other employees of the public agency
<br />be processed as an unfair practice charge and that
<br />a complaint raised in the context of a board investi-
<br />gation into unit determination, representation,
<br />recognition, or elections be processed as part of

<br />A 1141 (Diaz). Meyers - Milias -Brown Act.
<br />Agency Shop Agreements. AB 1141 amends the
<br />local agency collective bargaining law, known as
<br />the "Meyers - Milias -Brown Act' (MMBA) to extend
<br />agency shop agreements to confidential and
<br />supervisory employees. The MMBA, unlike most
<br />employment law including those affecting most of
<br />the other public employees in this state, generally
<br />permits management and confidential employees to
<br />join represented units of employees and to partici-
<br />pate in the collective bargaining process. This
<br />creates a built -in conflict of interest for manage-
<br />ment and confidential employees that does not
<br />exist in other labor laws. The MMBA provides for
<br />agency shop agreements that can be imposed
<br />without the agreement of the local agency and
<br />would generally require union membership or
<br />alternative dues payment from all members of a
<br />bargaining unit. In recognition of the conflict
<br />between forced participation of management and
<br />confidential employees in employee groups, they
<br />have been exempted from the agency shop provi-
