The bill
would require that a complaint alleging any viola-
tion of any rules and regulations adopted by a
public agency regarding the designation of man-
agement and confidential employees of a public
agency and restricting those employees from
representing any employee organization that
represents other employees of the public agency
be processed as an unfair practice charge and that
a complaint raised in the context of a board investi-
gation into unit determination, representation,
recognition, or elections be processed as part of
that proceeding. AB 1141 amends the
local agency collective bargaining law, known as
the "Meyers - Milias -Brown Act' (MMBA) to extend
agency shop agreements to confidential and
supervisory employees. The MMBA, unlike most
employment law including those affecting most of
the other public employees in this state, generally
permits management and confidential employees to
join represented units of employees and to partici-
pate in the collective bargaining process. This
creates a built -in conflict of interest for manage-
ment and confidential employees that does not
exist in other labor laws. The MMBA provides for
agency shop agreements that can be imposed
without the agreement of the local agency and
would generally require union membership or
alternative dues payment from all members of a
bargaining unit. In recognition of the conflict
between forced participation of management and
confidential employees in employee groups, they
have been exempted from the agency shop provi-
sions of MMBA.
