acts, omissions, negligence or willful misconduct of DU or its officers, agents, <br /> employees, servants, contractors or subcontractors, provided that this indemnity shall <br /> not apply to claims for which one or more of Indemnitees have been found in a court of <br /> competent jurisdiction to be solely liable by reason of its or their own active negligence <br /> or willful misconduct. <br /> DU waives any and all rights to any type of express or implied indemnity or right <br /> of contribution from the City, its officers, agents, or employees, for any liability resulting <br /> from, growing out of, or in any way connected with or incident to this Agreement. <br /> The duty of DU to indemnify and save harmless, as set forth herein, shall include <br /> the duty to defend as set forth in Section 2778 of the California Civil Code. <br /> 8. INSURANCE <br /> A. DU shall acquire and maintain Workers Compensation, employer's <br /> liability, commercial general liability, owned and non -owned and hired automobile liability <br /> insurance coverage (if applicable as indicated below) relating to DU's activities funded <br /> hereunder. The minimum amounts of coverage corresponding to the aforesaid <br /> categories of insurance per insurable event shall be as follows: <br /> Insurance Category Minimum Limits <br /> Workers Compensation statutory minimum <br /> Employer's Liability $1,000,000 per accident <br /> for bodily injury, personal <br /> injury and property damage <br /> Commercial General $1,000,000 per occurrence <br /> Liability for bodily injury, personal <br /> injury, and property damage. <br /> If the submitted policies contain aggregate <br /> limits, general aggregate limits will apply <br /> separately to the work under this Agreement <br /> or the general aggregate will be twice the <br /> required per occurrence limit. <br /> Course -of- Construction Completed value of the project with <br /> (Builder's Risk) no coinsurance penalty provisions. <br /> Automobile Liability ISO Form Number CA 0001, Code 1 <br /> B.
