8.B. - Page 4 <br /> well. For the two options further described below, an ERN is also included <br /> and the recommendation for a short negotiation period applies in those <br /> cases as well. The period can be extended in any case if deemed <br /> appropriate. <br /> • Request for Proposals. This option would be similar to a RFP under the <br /> City Charter, but because the RDA has broader powers concerning the <br /> disposition of real property, the Agency would have greater flexibility in <br /> selecting the developer and establishing specific development. Circulating <br /> an RFP in this case would provide an opportunity to consider a variety of <br /> creative approaches to developing Block 2 and/or the Winslow Lot. Unlike <br /> the City, the RDA is not required to sell property to the highest bidder, <br /> although it must secure a price not less than what is justified by the <br /> development opportunity considering the use, constraints, and criteria <br /> imposed by the agency. Developers would submit proposals which would <br /> show site plans, architectural renderings, and tenant types, allowing such <br /> factors to be considered by the Agency when selecting a developer. After <br /> evaluating and making a selection, the RDA could enter into an ERN <br /> agreement with the selected developer. As with the City Charter scenario, <br /> the RFP could be structured to allow proposals for Block 2 alone, the <br /> Winslow Lot alone, or for both sites together. While a RFP has many <br /> benefits, it may not attract the broadest group of candidates possible. <br /> Some developers avoid RFPs due to a concern that significant resources <br /> will be expended without any assurance of getting the project, or because <br /> of fears that if they lose, ideas of theirs may be used by the winning <br /> proposer. A Request For Qualifications (RFQ) process, described below, <br /> can widen the field of potential developers by avoiding these concerns. <br /> • Request for Qualifications �RFQ� A RFQ would request that, rather than <br /> submitting designs, the developers submit their qualifications for the <br /> project. These qualifications can include strong financing, experience with <br /> similar projects, a strong track record of local work, or other factors <br /> specified in the RFQ. After evaluating and making a selection, the RDA <br /> could enter into an ERN agreement with the selected developer. As with <br /> an RFP, the RFQ could be structured to allow proposals for Block 2 alone, <br /> the Winslow Lot alone, or for both sites together. <br /> ALTERNATIVES <br /> 1. Request staff to return with more information at a future meeting. <br /> 2. Direct staff to defer further work on these sites until additional information is <br /> available for High-Speed Rail or until another benchmark of Council's choice has <br /> been reached. <br /> FISCAL IMPACT <br /> At this time, the primary cost associated with exploring these development opportunities <br /> is staff time. The City is also now in contract for various professional services, but <br /> intends to pass those costs to the selected developer as part of the business terms of <br />
