6.1.E. - Page 4 <br /> individual Fire Fighters and Captains as well as crew performance <br /> standards, which are to be demonstrated annually. <br /> 2. Term. Unless earlier terminated in writing by any one of the Parties <br /> pursuant to Section 17 below, the term of this Agreement will commence upon the date <br /> first written above and shall continue in full force and effect for a period of three years or <br /> until terminated in writing by either party pursuant to Section 17, Termination. <br /> 3. Compensation. Fire JPA shall compensate City for providing Training <br /> Officer services as follows: <br /> A. Fire JPA agrees to pay City thirty-three percent (33%) of Training Officer's <br /> total salary and benefit package (normalized PERS rate). Accordingly, Fire <br /> JPA's financial obligation to City for services rendered by Coordinator <br /> pursuant to this agreement equates to $74,000 for FY 2010-2011 and <br /> shall be payable in arrears in quarterly installments in response to invoices <br /> from City. Any proposed adjustment made by City to Fire JPA's financial <br /> obligation during the term of this Agreement shall be submitted to Fire JPA <br /> for prior approval at least 60 days prior to effective date of said <br /> ad j ustment. <br /> B. In the event of the termination of this Agreement by either City or Fire <br /> J PA, City shall be entitled to payment for the services performed as of the <br /> d ate of te rm i n at i o n. <br /> C. In the event City is required to pay Training Officer for overtime as a direct <br /> result of the services provided by Training Officer to Fire JPA, Fire JPA <br /> will reimburse City the sum due for such overtime compensation. In the <br /> event Training Officer works overtime to provide Training Officer services <br /> after 5:00 p.m. on weekdays, or Battalion Chief services on a weekend, <br /> the City shall invoice Fire JPA for the costs of that coverage. Any <br /> payments made pursuant to the preceding sentence shall be made within <br /> two weeks of receipt of that invoice. <br /> 4. Pa ment. The City shall submit quarterly invoices to Fire JPA reflecting <br /> the hours worked by the Training Officer pursuant to this Agreement. Payments shall be <br /> made within (30) days of invoice. <br /> 5. Emplovment. The designated Training Officer shall not be deemed a Fire <br /> JPA employee for any purpose. <br /> A. City's Fire Chief will provide overall supervision of the Training Officer. In <br /> the event of a conflict between direction given by City Fire Chief and Fire <br /> JPA Chief, the City Chief and the Fire JPA Chief will meet and use their <br /> best efforts to resolve the conflict. <br /> ATTY/AGR/2011. 041 Belmont SC Fire Training Officer <br /> 051311 2 <br />
