ARTICLE 9. D URATION <br /> The covenants contained in Article 1 of this Covenant and the repurchase rights <br /> set forth in Article 5 of this Covenant shall be deemed to run with the land in accordance <br /> with Section 33334.3(0 of the Health and Safety Code or any successor statute and <br /> shall remain in effect for not less than fifty-five (55) years following recordation of this <br /> Covenant. The covenants against discrimination contained in paragraphs 5 and 6 of <br /> this Covenant shall be deemed to run with the land in accordance with Section 33438 of <br /> the Health and Safety Code or any successor statue and shall remain in effect in <br /> perpetuity. <br /> ARTICLE 10. SUCCESSORS AND ASSIGNS <br /> The covenants contained in this Covenant shall be binding for the benefit of the <br /> City, the Agency and their respective successors and assigns, third party beneficiaries, <br /> and any successor in interest to the Site or any part thereof, and such covenants shall <br /> run in favor of the City, the Agency and such aforementioned parties for the entire <br /> period during which such covenants shall be in force and effect, without regard as to <br /> whether the City or the Agency is or remains an owner of any land or interest therein to <br /> which such covenants relate. The City, the Agency, and such aforementioned parties, <br /> in the event of any breach of any such covenants, shall have the right to exercise all of <br /> the rights and remedies, and to maintain any actions at law or suits in equity or other <br /> proper proceedings to enforce the curing of such breach.
