9, /3 <br />LOW slative Action <br />now <br />Firefighters. SB 440 passed the Assembly floor <br />on a 55 -11 vote on July 21. The bill attempts to <br />circumvent the California Supreme Court decision <br />in County of Riverside v. Superior Court that <br />overturned binding interest arbitration procedures <br />established by SB 402 (Burton, Chapter 906, <br />Statutes of 2000). SB 402 provided that if a <br />collective bargaining impasse regarding economic <br />issues has been declared between a local gov- <br />ernment and representatives of specified public <br />safety employees, and if other available adminis- <br />trative remedies have been exhausted, the em- <br />ployee organization may request submission of <br />the differences to binding interest arbitration. That <br />law also provided that the decision of the arbitrator <br />on economic issues was binding on the parties. <br />SB 440 attempts to defeat the decision of the <br />Supreme Court in County of Riverside v. Superior <br />Court by the dubious provision that the decision of <br />the arbitrator may be overturned by a unanimous <br />decision of the board of supervisors or city coun- <br />cil.
