E3 A -9� <br />Commissioner Seybert asked what the process would be for a "meeting of the minds ", if <br />Kaiser and the City did not agree as to what Kaiser's fair share (based on the impacts) <br />would be. <br />Mr. Church said there would first be an informa discussion between the applicants, <br />hopefully with some agreement with the numbers. He said, ultimately, under the law, <br />there is a requirement that the City prove that there is a nexus between the charges and <br />the generation of the impact. He said depending on how much of an argument there is <br />about those costs, there will more or less be an elaborate report that will go the City <br />Council for final approval, and the argument would get laid out there. <br />Chair Foust asked for a motion. <br />Commissioner Seybert asked Assistant City Attorney Damien Brower what the motion <br />was supposed to be. <br />Mr. Brower said it is what the PC is looking at in the Recommendation. There are two <br />actions to either recommend or not recommend: <br />Review the revised wording in the Precise Plan and recommend that the City <br />Council adopt the Downtown Medical Campus as amended. <br />2. Find the Zoning Map Amendment to rezone the real property at the Kaiser <br />Permanente Downtown Medical Campus from "CA" (Commercial Administrative) <br />and "CB" (Central Business) to 'P" (Planned Community) Zoning District to be in <br />the public interest and recommend that the City Council approve the Zoning Map <br />Amendment. <br />Mr. Brower said it should be two different votes. <br />M /S: (Radcliffe /Seybert: That the PC vote on the Precise Plan with the revisions as <br />noted, and recommend approval of the Precise Plan. <br />Motion passed 5 -0 (McCoy and Piulle — Absent) <br />M /S: (Paulson /Seybert: That the PC find that the Zoning Map Amendment to rezone the <br />real property of the Kaiser Permanente Downtown Medical Campus from "CA" <br />(Commercial Administrative) and "CB" (Central Business) to a "P" (Planned Community) <br />and zoning District to be in the public interest and recommend that the City Council <br />approve the Zoning Map Amendment. <br />Motion passed 5 -0 (McCoy and Piulle — Absent) <br />5. MATTERS OF COMMISSION INTEREST <br />a. 852 -860 Walnut Avenue: Discussion on changes to previously approved 15 unit <br />infill project. <br />Zoning Administrator Jill Ekes said since the PC last saw this matter, the Precise <br />Plan, (Zoning Map Amendment) was approved by the City Council. She said the <br />project was sold to a new developer, who is looking to do a similar project, but with <br />some changes. Ms. Ekas said staff wanted to inform the PC of those changes <br />before staff comes back for Planned Community Permit. She referred to the memo <br />Page 4 of 7 <br />
