ZONING TEXT AMENDMENT - PUBLIC HEARING
Proposed Amendments to the Zoning Ordinance related to:
1. The Construction of Arbors and Trellises in Setback Areas.
2. Definitions, Land Use Classifications, and Parking Standards for Medical Offices,
Medical Clinics, and Research and Development Uses.
3. Definitions and Standards for Measurement of Residential Height.
4. Definitions and Allowances for "Theater" Uses in the Central Business Retail (CBR)
District.
5. Provisions to Accommodate Child Care Facilities.
Chair Foust asked Tom Passinisi, Principal Planner, to give an overview.
Mr. Passanisi said the purpose of these five Zoning Text Amendments is to essentially
clean up the Zoning Ordinance, bring it to conformance with common and acceptable
development practice, and also to clarify some of the Planning language. He said the
Amendments are pretty straight forward, but he wanted to elaborate on the Large Family
Child Care Ordinance Amendment.
He said the published Zoning Ordinance as it relates to Large Family Child Care simply
needs to be changed. Per an opinion by the City Attorney's office, the current wording in
the Zoning Ordinance does not conform to State law, and does not meet the intent of
past City Council action. He said a recent Grand Jury Report recommended that the
City amend the Ordinance to comply with State law. The City Council's original intent
was to establish a Non - discretionary Permit Process; however, the wording in the
current Ordinance reflects a Use Permit Process, meaning it requires notification and a
Public Hearing.
