8A2s <br />Legislative Bill Action <br />................................ ............................... <br />AB 936 (Reyes). Trespass. Maternity <br />Wards. AB 936 defines a new form & trespzss <br />committed wfrere a person enters or remains ?n a <br />maternity ward or birthing center under circum- <br />stances that indicate the trespasser has no lawful <br />business in the premises. AB 936 provides that <br />trespassing in a maternity ward or birthing facility <br />is subject to the following penalties: A first convic- <br />tion, where a person leaves upon request, results <br />in an infraction - punishable by a fine up to $100. A <br />first conviction where a person refuses to leave <br />after being requested to do so by peace officer or <br />authorized personnel results in a misdemeanor - <br />punishable by a imprisonment of up to one year in <br />county jail, a fine of up to $1,000, or both. A <br />second or subsequent conviction results in a <br />misdemeanor, punishable by imprisonment in <br />county jail for up to one year, a fine of up to <br />$2,000, or both. AB 936 also provides that the <br />court shall order counseling as a condition of <br />probation, and order the defendant to pay for the <br />counseling, unless the court finds good cause to <br />not make such orders. AB 976 is intended <br />to close current loopholes in the existing law that <br />do not go far enough to ensure that victims and <br />derivative victims of crime in the State of California <br />are provided with the highest quality of services. <br />AB 976 amends the Government Code to define <br />"authorized representative" as an attorney, a <br />victim assistance advocate certified pursuant to <br />Penal Code Section 13835.10m, if the victim or <br />derivative victim is a minor or an incompetent <br />adult, the legal guardian or conservator, or an <br />immediate family member, parent, or relative <br />caregiver who is not the perpetrator of the crime <br />that gave rise to the claim, and, an immediate <br />family member of the victim or derivative victim <br />who has written authorization by the victim or <br />derivative victim and is not the perpetrator of the <br />crime that gave rise to the claim. AB 976 provides <br />that, except for attorney's fees awarded pursuant <br />to law, no authorized representative shall charge, <br />demand, receive, or collect any amount for his or <br />her services. AB 1044 makes specified <br />changes in the statutes pertaining to licenses to <br />carry concealable weapons (CCWs) in California. <br />AB 1044 removes the Department of Justice's <br />(DOJ) obligation to file and store all copies of <br />CCW permits and, instead, requires DOJ to <br />maintain a list of all CCWs. The DOJ has no <br />supervisory authority or oversight over sheriffs and <br />police chiefs regarding the issuance of these <br />permits, therefore making them unnecessary. <br />The obligation to file and store copies of CCW <br />permits results in significant burdens and ex- <br />penses with no benefits to DOJ. AB 1044 pro- <br />vides that DOJ will no longer be required to main- <br />tain hard copy printouts of firearm- related informa- <br />tion in its databases. Commonly, digital formatting <br />is the preferred and most efficient means to <br />provide such information, with less cost. AB 1044 <br />also relieves DOJ of the obligation to adopt and <br />implement the Standard CCW application form <br />and provides that DOJ review and, as necessary, <br />revise the standard CCW application. This bill <br />exempts the CCW applications form from the <br />requirements of the Administrative Procedures Act <br />by stating that the standard form is deemed to be <br />a local form and thus exempt from that Act. AB 1153 prevents city, county and state <br />identification cards from unlawful, unauthorized <br />manufacturing and sale of badges. Current law <br />does not control or regulate the manufacturing or <br />selling /loaning of county, state or city identification <br />badges. Following the events of September 11' ", <br />security has become a priority for the nation as <br />well as the League of California Cities and our <br />members. To allow the unauthorized and illegal <br />manufacturing of badges and identification cards <br />puts the public at great risk by allowing unlawful <br />access to public state, county and city facilities by <br />terrorists and others with criminal intent.
