9.5 <br /> <br />and Personnel Officer. The decision of the Personnel Officer on granting or <br />refusing to grant a leave of absence or extension thereof shall be final and <br />conclusive and shall not be subject to the grievance procedure of this MOU. <br />Except as otherwise provided in this Section, the maximum leave of absence shall <br />be for one (1) year. <br /> <br />During any approved leave of absence the employee shall not engage in gainful <br />employment unless authorized to do so by the written permission of the Personnel <br />Officer. The Personnel Officer may terminate any employee who violates the <br />terms and conditions of the written permission for leave or extension thereof. <br /> <br />Jur~ Duty <br /> <br />Any employee whose name shall be selected from the list of trial jurors to serve as <br />a juror in a civil or criminal action pending in a Superior, Municipal, or Justice <br />Court of the State of California, or any Federal Court convening in the State of <br />California, or any employee required to report for the selection ora jury in any of <br />these courts shall receive pay for the time such service requires his/her absence <br />from work; provided, however, that the City may require proof of the time such <br />service was required and any monies received from jury duty served during <br />scheduled work shifts shall be turned into the City; provided, further, that the <br />employee shall report to work whenever a reasonable portion of the shift remains <br />for completion. An employee required to serve as a juror may, upon mutual <br />agreement between the City and the employee, have his/her regular starting or <br />quitting time changed as a result of being called for jury service. <br /> <br />9.6 Maternity Leave of Absence Without Pay <br /> <br />9.6.1 <br /> <br />Maternity leave of absence without pay or benefits shall be granted upon <br />request to non-disabled probationary and permanent female employees for <br />that period of time requested up to one (1) year. <br /> <br />9.6.2 Maternity leave shall be granted when the following conditions have been <br /> met: <br /> <br />9.6.2.1 <br /> <br />The employee shall notify her immediate supervisor in writing <br />accompanied by her physician's certificate of pregnancy as <br />soon as possible after pregnancy has deftnitely been <br />determined, but no later than ninety (90) days prior to the <br />tentative date on which the leave is to begin. Such notice shall <br />include the tentative dates on which the leave shall begin and <br />end. <br /> <br />9.6.2.2 <br /> <br />Within thirty (30) days of the beginning of the maternity leave, <br />the employee shall submit to the Personnel Officer the specific <br />date she intends to begin the leave, accompanied by her <br /> <br />17 <br /> <br /> <br />
