Sale.'Transt'er to Very Low Income Household. For a proposed <br />sa',e or transfer ora Restricted Housing L'mt to a Very Low Income Household, the <br />O~t ncr of the Resmcted Housing Unit shall submit to the Agency documentation <br />supporting that the prospective purchaser,'transferee qualifies as a Very Low income <br />Household. <br /> <br /> 2. Sale/Transfer to Moderate Income Household. For a proposed <br /> sale or transfer of a Restricted Housing Unit to a Moderate Income Household, the <br /> Owner of'the Restricted Housing Unit shall submit to the Agency documentation <br /> supporting that the prospective purchaser/transferee qualifies as a Very Low Income <br /> Household or a Moderate Income Household. <br /> D. Owner's Notice oi~Sale. If an Owner of the Restricted Housing Unit <br /> intends to sell the Restricted Housing Ufiit, the Owner shall provide the Agency with <br /> wnrten notice, by certified mail, of such fact (the "Owner's Notice of Sale"). The <br /> Owner's Notice of Sale shall notify the Agency th~ it shall have ninety (90) days to <br /> identify an Eligible Household or exercise its right to purchase the Restricted Housing <br /> Unit. During such 90-day period, the Owner shall use its best efforts to identify a <br /> purchaser/transferee who may qualify as an Eligible Household to purchase the <br /> Restricted Housing Unit. <br /> <br /> E. Process to Obtain Approval ora Re-sale ora Restricted Housin~ Unit <br />to an Eligible Household. Within ten (10) business days from its receipt o£the income <br />certifications, Agency shall render a decision of eligibility or noneligibility based upon <br />the documentation submitted in Section 2.01(C). If the prospective purchaser/transferee <br />qualifies as an Eligible Household, the Agency shall notify the Owner and the Owner <br />shall sell the Restricted Housing Unit to such Eligible Household, provided such Eligible <br />Household can afford the Sales Price. <br /> <br /> F. Process for Re-sale ora Restricted Housin~ Unit to a Non-Eligible <br />Household. I['th~e prospective purchaser/transferee does not qualify as an Eligible <br />Household, the Agency shall notify the Owner and the Owner shall be obligated to either <br />locate another purchaser/transferee who qualifies as an Eligible Household, or wait until <br />the Agency exercises its right of first refusal to purchase the Restricted Housing Unit, as <br />provided in Section 2.02. Notwithstanding the foregoing sentence, if the Agency has <br />previously exercised its right of first refusal to purchase the Restricted Housing Unit, <br />Owner may sell or transfer the Restricted Housing Unit to a non-Eligible Household <br />pursuant to Section 2.04.. <br /> <br /> G. Documentation. The Owner shall execute a Disclosure Statement. <br />The form of Disclosure Statem, ent and a copy of this Cov~,a shall be given to each <br />purchaser prior to their purchase of the property. Each Eligible Household who is an <br />Owner thereafter shall execute the Disclosure Statement in the form anached hereto as <br />Exhibit B. <br /> <br /> H. Principal Residence. EACH OWN]iR OF THE RESTRICTED <br />HOUSiNG UNIT MUST OCCUPY THE HOUSE AS ITS PRINCIPAL RESIDENCE <br />FOR THE DURATION OF ITS OWNERSHIP.
