of the work not yet completed. If Agency shall have failed to provide such written
<br />statement within the ten (10) day period after such Agency meeting, Shea shall be
<br />deemed entitled to the Certificate of Completion.

<br />Article 6. COVENANTS; NONDISCRIMINATION
<br />
<br /> {}601 Covenants as to Uses
<br /> Subject to the Close of Escrow on an Acquisition Parcel, Shea covenants and
<br />agrees that during construction and thereafter, Shea shall devote the Shea Project Site to
<br />the uses specified in the Redevelopment Plan, the Grant Deed or Grant Deeds and this
<br />Agreement for the period of time specified in Section 602. The foregoing covenant shall
<br />mn with the land. In order to assure and monitor compliance with Shea's affordable
<br />housing obligations under the CRL, CEQA, Replacement Housing Plan and this
<br />Agreement, within ten (10) days after Shea's Election to Fund, Agency and Shea will
<br />enter into a separate covenant (the "Afford'able Housing Covenant") substantially in the
<br />form attached hereto as Attachment 12, and may execute other agreements mutually
<br />acceptable to Shea and Agency, that sets forth the manner in which Shea will satisfy the
<br />affordable housing requirement and monitor compliance with such requirement.
<br />
<br /> §602 Nondiscrimination
<br />
<br /> Shea covenants that it shall not discriminate against or segregate any person or
<br />group of persons on account of race, color, creed, religion, handicap, sex, sexual
<br />preference, marital status, national origin, or ancestry in the sale, lease, sublease, transfer,
<br />use, occupancy, tenure or enjoyment of the Shea Project Site, nor shall Shea establish or
<br />permit any such practice or practices of discrimination or segregation with reference to
<br />the selection, location, number, use or occupancy of tenants, lessees, subtenants,
<br />sublessees or vendees of the Shea Project Site. The covenants set forth in this section
<br />shall mn with the land.
<br />
<br /> Shea shall refrain from restricting the rental, sale or lease of the Shea Project Site
<br />on the basis of race, color, creed, religion, handicap, sex, sexual preference, marital
<br />status, national origin, or ancestry of any person. All such deeds, leases or contracts shall
<br />contain or be subject to substantially the following nondiscrimination or nonsegregation
<br />clauses:

<br /> A. In deeds: "The grantee herein covenants by and for himself or herselfi
<br />his or her heirs, executors, administrators, and assigns, and all persons claiming under or
<br />through them, that there shall be no discrimination against or segregation of, any person
<br />or group of persons on account of race, color~ creed, religion, handicap, sex, sexual
<br />preference, marital status, national origin, or ancestry in the sale, lease, sublease, transfer,
<br />use, occupancy, tenure or enjoyment of the premises herein ~o_nveyed, nor shall the
<br />grantee or any person claiming under or through him or her, establish or permit any such
<br />practice or practices of discrimination or segregation with reference to the selection,
<br />location, number, use or occupancy of tenants, lessees, subtenants, sublessees or vendees
<br />in the premises herein conveyed. The foregoing covenants shall run with the land."
