ATTACHMENT 9 <br />GRANT DEED <br /> <br />RECORDING REQUESTED BY <br />AND WHEN RECORDED MAIL TO: <br /> <br />(Space above this line for Recorder's use only) <br />Document Transfer Tax $ <br /> <br />GRANT DEED <br /> <br /> FOR A VALUABLE CONSIDERATION. receipt of which is hereby acknowledged, <br />the REDEVELOPMENT AGENCY OF THE CITY OF REDWOOD CITY, a body <br />corporate and politic created pursuant to the Community Redevelopment Law of <br />California ("Grantor"), hereby grants to SHEA HOMES, L.P., a California limited <br />parmership ("Grantee"), the parcel of real property in the City of Redwood City, County <br />of San Marco, State of California (the "Property") described in Exhibit "A" attached <br />hereto and by this reference made a part hereof, and designated APN Number in the <br />Agreement, as defined below. <br /> <br /> The Property, and the possession and use thereof by the Grantee and its successors in <br />interest, shall be subject to all of the provisions of the Disposition and Development <br />Agreement for the Franklin Street Project, Shea Homes Project executed by Grantor and <br />Grantee effective (the "Agreement"), until the recordation by the Grantor of <br />the Certificatas-~Uompletion covering development of the Property described in <br />Section 517 of the Agreement, at which time only the covenants against discrimination <br />[end affordable bousing]I set forth in the final paragraph of this Grant Deed shall survive. <br />The Grantor has the limited and conditional tight to the return of title and possession <br />of the Property and all improvements thereon, and to the termination and revesting in the <br />Grantor of the estate conveyed to the Grantee hereby, as such tight is set forth in <br />Section 810 oftbe Agreement; provided that such tight to reenter, rake possession, <br />terminate and revest in connection with a Project Phaseshall expire and be of no-further <br />force or effect upon the recordation by the Grantor of the Certificate of Completion for <br />such Project Phase. <br />The Grantee herein covenants by and for itself, its heirs, executors, administrators and <br />assigns, and all persons claiming under or through them, that there shall be no <br />discrimination against or segregation of. any person or group of persons on account of <br /> <br />~ Applies only to parcels subject to the Affordability Covenant and Restrictions on Resale contained in <br />Attachment 12 to the Agreement. <br /> <br />wc-32228 I <br /> <br /> <br />
