ATTACHMENT ~ ~l <br /> <br />CERTIFICATE OF COMPLETION <br /> <br /> THIS CERTIFICATE OF COMPLETION ("Certificate") certifies that SHEA HOMES, L.P., <br /> a California limited partnership (the "Developer"), has complied with all terms and conditions <br /> contained in that certain document entitled Disposition and Development Agreement for the <br /> Franklin Street Project, Shea Homes proJect, dated ,19__ ("DDA"), by and between <br />the REDEVELOPMENT AGENCY OF THE CITY OF REDWOOD CITY ("Agency") and the <br />Developer governing the Developer's obligations to construct a Project Phase of the Shea Project <br />described therein as more particularly described in Section 108(D) and shown on <br />Attachment 4(b) to the DDA. The Project Phase development described in the DDA is thus <br />hereby deemed complete and accepted in all respects by the Agency, within the meaning of <br />Section 517 of the DDA, and neither the Agency nor any other person shall have any fight, <br />remedy or control pursuant to the DDA h'ete, at~er, including without limitation any right to <br />reenter the property or revest in the Agency the estate conveyed to the Developer or exercise any <br />other rights provided in Section 810 of the DDA. Furthermore, the encumbrance created by the <br />following language: <br /> The Grantor has the limited and conditional fight to the return of title <br /> and possession of the Property and all improvements thereon, and to the <br /> termination and revesting in the Grantor of the estate conveyed to the <br /> Grantee hereby, as such fight is set forth in Section 8 I0 of the Agreement; <br /> provided that such nght to reenter, take possession, terminate and revest <br /> shall expire and be of no fuxther force or effect upon the recordation by the <br /> Grantor of the Certificate of Completion for such Project Phase. <br />appearing in the deed from the Agency to Shea, recorded in the Office or the Recorder of the <br />County of San Mateo on as Document No. (the "Grant Deed") is <br />hereby removed. <br /> <br /> Nothing contained in this Certificate of Completion shall be deemed to waive or otherwise <br />affect in any way the covenants against discrimination set forth in the final paragraph of the <br />Grant Deed, which~sions shall survive the recordation of this Certificate. <br /> <br />Dated: <br /> <br />REDEVELOPMENT AGENCY OF THE CITY OF <br />REDWOOD CITY <br /> <br />ATTEST: <br /> <br />Executive Director <br />Pursuant to Agency Resolution <br />No. <br /> <br />Secretary <br /> <br />~,c-32236 <br /> <br /> <br />
