case is brought under 42 USC 1983; a fee award is available under 1988(b). <br /> <br />Because of the tendency of challengers to "attack the whole thing," analysis of isolated portions <br />of a sign ordinance, such as the three current issues, is of limited usefulness. If the City is <br />oriented to problem prevention, it makes the most sense to couple the three current items with a <br />review and analysis of the entire sign ordinance (RCMC Chapter 3, Articles II and III only). I <br />propose to provide a review consisting of a detailed commentary which identifies points of likely <br />attack, citations to relevant case authority, and suggestions for reducing the vulnerability. While <br />constitutionality is the big issue, there are other issues, mostly arising from special state statutes. <br />The analysis memo would likely run 10 to 15 pages. <br /> <br />My fee for this review coupled with the consultation on the three current issues would be $3,500 <br />plus $185 per hour for phone, fax or email consultation in excess of two hours. Other than <br />standard text which I recommend for all sign ordinances, the review and commentary does not <br />include redrafting work. If the City wishes me to make any in-person presentations, that is also at <br />$185 per hour, with travel time at half rate; I can also do phone presentations to groups, if <br />desired, at the same rate. I understand your office will provide me with an electronic version (MS <br />Word or WordPerfect/Win) of the current sign ordinance. Legal assistant and secretarial time (if <br />any - probably not need in this case) is billed at $30 per hour. My billing is monthly. I do not <br />charge for long distance phone calls, postage, fax or electronic research such as Lexis, Westlaw, <br />and Loislaw. I have current insurance coverage orS1 million for professional errors and <br />omissions. <br /> <br />My resume follows.
