Fire JPA: Belmont -San Carlos Fire Department Attn: Fire Chief 600 Elm Street, 2 Floor San Carlos, CA 94070 Except as otherwise stated, all notices to be provided or that may be provided under this Agreement must be in writing and delivered by regular and certified mail. Each party will notify the other immediately of any changes of address that would require any notice or delivery to be directed to another address. 12. Jurisdiction and Venue. Any action at law or in equity brought by any of the Parties for the purpose of enforcing a right or rights provided for or by this Agreement will be tried in a court of competent jurisdiction in the County of San Mateo, State of California, and the Parties waive all provisions of law providing for a change of venue in these proceedings to any other county. 13. Litigation Support. City will make the designated Fire Marshal available to testify in any litigation or administrative hearing which occurs following the termination of this Agreement. Fire JPA shall compensate City for its costs and expenses for designated Fire Marshal's preparation, travel, and testimony in such matters at the employee's then current hourly rate of compensation, unless such litigation or administrative matter is brought by City or is based solely on allegations of City's negligent performance or wrongdoing. 14. Severability. If any term or portion of this Agreement is held to be invalid, illegal, or otherwise unenforceable by a court of competent jurisdiction, the remaining provisions of this Agreement shall continue in full force and effect. 15. General Compliance with Laws. Parties will keep fully informed of federal, state and local laws and ordinances and regulations which in any manner affect those employed by Parties, or in any way affect the performance of the Services by Parties. Parties will at all times observe and comply with these laws, ordinances, and regulations and will be responsible for the compliance of Parties Services with all applicable laws, ordinances and regulations. 16. Discrimination and Harassment Prohibited. Parties will comply with all applicable local, state and federal laws and regulations prohibiting discrimination and harassment. 17. Termination. This Agreement may be terminated without cause by any Party upon giving written notice thereof thirty (30) days or more prior to the effective date. The effective date shall be set forth in the notice of termination, provided however, if such effective date is not set forth in the notice of termination, then in that event the effective date of termination shall be thirty (30) days after deliver or posing of said notice.
