6.2.D. - Page 1 <br /> To the Honorable Mayor and City Cou nci I <br /> From the City Manager <br /> J u ne 13, 2011 <br /> SUBJECT <br /> Final Acceptance — Maddux and Stafford Parks Sand Play Area Renovation <br /> RECOMMENDATION <br /> Accept, by motion, the Maddux and Stafford Parks Sand Play Area Renovation Project <br /> and authorize the release of bonds and retention according to city procedures. <br /> BAC KG RO U N D <br /> On October 11, 2010, Council awarded the construction contract for the Maddux and <br /> Stafford Parks Sand Play Area Renovation Project to the lowest responsive and <br /> responsible bidder, Silicon Valley Builders of San Jose, for their bid of $82,659.00. <br /> This project removed the sand from the sand play areas and replaced it with ADA <br /> compliant rubberized play surfacing and added water features with new frog sculptures <br /> at Maddux Park and a new snail sculpture at Stafford Park. The work at Maddux Park <br /> was substantially completed and was re-opened for use on January 22, 2011. The tot <br /> area was re-opened at Stafford on January 29, 2011. <br /> The Maddux and Stafford Parks Sand Play Area Renovation Project was successfully <br /> completed in accordance with the plans and specifications for a total contract cost of <br /> $84,801.00. Change orders were issued for the sum total of $2,142.00, which is 2.6% <br /> more than the contract amount originally awarded. The sole change order was issued <br /> to substitute a spring-loaded actuator for an air-loaded one on the supply to the water <br /> feature at Stafford Park to conserve water. It is much easier to temporarily modify a <br /> spring-loaded actuator which may allow water to remain on past the period of time it is <br /> needed. Formal acceptance of this project was delayed until the preferred device was <br /> received and installed. The city did not charge the contractor for liquidated damages <br /> nor did the contractor file a delay claim as a result. <br /> The contract allowed 60 days for project completion and substantial completion was <br /> achieved at both sites within the time allowed by contract. Construction at Maddux Park <br /> started November 18, 2010 and substantial completion was achieved on January 22, <br /> 2011. Construction at Stafford Park started on November 29, 2010 and substantial <br /> completion was achieved on January 29, 2011. <br />
