5.38..]

REPORT

To the Honorable Mayor and City Council
From the City Manager

January 10, 2005

Subject
Repeal of City Council Resolution 14468 related to conflicts of interest.

Recommendation
That the City Council adopt the attached resolution repealing Resolution No. 14468.

Background
On November 22,2004, the City Council approved Resolution No. 14617 and adopted a
revised Conflict of Interest Code for the City. Among other things, Resolution No. 14617
repealed 9 prior resolutions relating to the City's Conflict of Interest Code. Although
Resolution No. 14617 referred to Resolution 14468 (also related to conflicts of interest) it
did not expressly repeal the latter resolution.

While it is clear that Resolution No. 14617 sets forth the City's current Conflict of Interest
Code, the City Attorney and City Clerk feel it important to ensure that all outstanding
resolutions related to conflicts of interest have been formally repealed so as to reduce
potential future confusion. The attached resolution expressly repeals Resolution No.
14468 and is consistent with Council action taken on November 22,2004.

Alternative
Do not repeal Resolution No. 14468 and leave in place a resolution that has been
superseded by subsequent City Council action

Fiscal Impact
None

,

. ,1i1- "w..:~~.1 ~,,~L)

Patricia Howe
City Clerk

Attyl AgendaReports/Repeal Reso 14468
121504
