<br />".2,8-1 <br /> <br />REPORT <br /> <br />To the Honorable Mayor and City Council <br />From the City Manager <br /> <br />February 28, 2005 <br /> <br />Subject <br />Final Acceptance - Construction of Improvements for 1250 Jefferson Avenue <br /> <br />Recommendation <br />Accept, by motion, the construction improvements for 1250 Jefferson Avenue (Whole <br />Foods Market), and release the bonds following the submission of a Maintenance Bond <br />in the amount of $6,600.00, in accordance with paragraph 8 of the Agreement. <br /> <br />Background <br />On September 13, 2004, the City Council approved the Agreement for Construction of <br />Improvements for 1250 Jefferson Avenue. The developer, Whole Foods Market <br />Northern Pacific, has completed the construction of improvements in accordance with <br />the Agreement, the plans and specifications, and to the satisfaction of Engineering and <br />Construction Services. The owner provided a Faithful Performance Bond and a <br />Payment Bond, each in the amount of $66,000.00. <br /> <br />The City-approved permits for the Whole Foods grocery store required the developer to <br />construct certain public works improvements to provide services to the new building, <br />and to protect the general welfare of the public. In order to accommodate vehicular <br />traffic wishing to access northbound EI Camino Real after exiting the site, the <br />improvements included construction of a curb opening in the median island on <br />Jefferson Avenue, so that vehicles exiting the site on Adams Street can make a left turn <br />onto eastbound Jefferson Avenue. Also; as a traffic safety measure, the driveway <br />access to the site on EI Camino Real was narrowed to restrict the opening, thus <br />allowing only entering vehicles. <br /> <br />Alternative . <br />The only alternative is to not accept the improvements, which would be contrary to <br />public policy. <br /> <br />Fiscal Impacts <br />There are no impacts to the City, except for a minor amount of increased pavement and <br />markings to be maintained. <br /> <br /> <br />Richard Haygood <br />Senior Civil Engineer <br /> <br />I !1atterson <br />ommunity Development Services Director <br /> <br />/i <br />. .
