07/14/2003 <br />ORIGINAL <br />RESOLUTION NO. 14536 <br />RESOLUTION AUTHORIZING CITY CLERK TO PUBLISH SUMMARY <br />OF PROPOSED ORDINANCE OR AMENDMENT TO EXISTING <br />ORDINANCE <br />WHEREAS, Section 15 of the Redwood City Charter prohibits any ordinance <br />from being passed by the City Council on the day of its introduction, nor within five (5) <br />days thereafter, nor until its publication at least once in the official newspaper of the City <br />at least three (3) days before its adoption; and <br />WHEREAS, Section 71 of the Redwood City Charter makes all general laws of <br />the state applicable to municipal corporations, including those relating to "municipal <br />affairs," and which are not in conflict with the provisions of the charter or with <br />ordinances or resolutions hereafter enacted, applicable to the city; and <br />WHEREAS, the general law of the state, as to publication of ordinances, is <br />embodied in California Government Code section 369933, which requires that within <br />fifteen (15) days after the passage of an ordinance, it must be published at least once in <br />a newspaper of general circulation; and <br />WHEREAS, alternatively, California Government Code section 36933, allows for <br />publication of summaries of proposed ordinances or amendments to existing ordinances <br />if: <br />1. Prepared by an official designated by the city council; and <br />2. At least five (5) days prior to adoption of the proposed ordinance or <br />amendment to existing ordinance, a summary is published and a certified <br />copy of the full text of the proposed ordinance is posted in the office of the <br />city clerk; and <br />3. Within fifteen (15) days after adoption, a summary of the ordinance with <br />the names of those council members voting for and against the ordinance <br />shall be published; and <br />4. The City Clerk's office posts a certified copy of the full text of the adopted <br />ordinance along with the names of those council members voting for and <br />against the ordinance. <br />AND, WHEREAS, the City Clerk of Redwood City has reported that currently a <br />24 -page ordinance has been introduced by the City Council and is now ready for <br />publication; however the time and expense of publishing the entirety of said ordinance <br />in the official newspaper of the City would be burdensome and not cost effective; and <br />F:Atty /Reso /Reso.1406 14536 <br />070903 1 <br />
