6.1.E. - Page 5 <br />WHEREAS, City and County wish to again amend the City Agreement as set <br />forth below to be consistent with the Third Amendment to the Agreement and PHS land <br />lease, which Third Amendment is attached hereto as Exhibit A; <br />NOW, THEREFORE, IN CONSIDERATION OF THE MUTUAL <br />PROMISES PROVIDED HEREUNDER, THE PARTIES AGREE TO THE <br />FOLLOWING: <br />1. Subparagraph 8 Term and Effective Period of Section D. GENERAL <br />PROVISIONS of the City Agreement, previously deleted and replaced in its <br />entirety in the First Amendment and Second Amendment, is hereby deleted <br />and replaced in its entirety by the following: <br />"8. Term and Effective Period. This Agreement shall be effective the <br />period from July 1, 2011 through June 30, 2015. All services are subject to <br />the terms and conditions of this Agreement." <br />2. Subparagraph 4 Pavments of Section B. CITY'S RESPONSIBILITIES of <br />the Services Agreement, previously deleted and replaced in its entirety in the <br />First Amendment and Second Amendment, is hereby further deleted and the <br />following substituted in lieu thereof: <br />"4. Pavments <br />a. City shall pay to the County prior to January 1" of each fiscal <br />year, and following the receipt of an invoice from County, the <br />City's percentage share of the net program cost of the Animal <br />Control Program. This net program cost shall be determined by <br />the County and shall be equal to the cost of the contract between <br />the County and County Contractor plus the cost of the County <br />administering licensing collection and Animal Control Services <br />Program, minus any program revenue received by County or <br />County Contractor as described in Section D, Paragraph 5. County <br />and City's percentage share shall be based on service costs. <br />County will calculate a percentage breakdown annually, based on <br />service reports provided by County Contractor. Percentage <br />distribution for a given year will be based on an average of service <br />costs over the three calendar years prior to the year in question. <br />Exhibit `B ", attached and incorporated by this reference herein, <br />details percentage distribution for FY 2003 -04. Percentage <br />distributions for each fiscal year will be distributed by County to <br />City by March 31 ". <br />b. Base costs to be paid to County Contractor by the County and <br />City are as follows, inclusive of the rabies investigation and <br />quarantine services as described in the First Amendment as <br />ATTY /AGR /2011 /AMEN DIM ENTS /AMEND NO.3 ANIMAL CONTORL <br />060711 -2- <br />
