MEMORANDUM FROM THE CITY ATTORNEY <br />CONCERNING A CLOSED SESSION BEFORE <br />THE CITY COUNCIL OF THE CITY OF REDWOOD CITY <br />TO: Honorable Mayor and Members of the City Council <br />FROM: Pamela Thompson, City Attorney <br />SUBJECT: Closed Session — Deciding whether to initiate litigation. <br />[Government Code §54956.9 (c)] <br />A closed session will be held on June 27, 2011, for the purpose of conferring with and /or <br />receiving advice from your legal counsel concerning whether to initiate litigation, [Gov't. Code <br />§54956.9 (c)] and for the purpose of giving instructions to your negotiator regarding the price <br />and terms of payment for the purchase, sale, exchange or lease of real property. [Gov't. Code <br />§54956.8] <br />If the City Council authorizes the City Attorney to defend, or seek or refrain from seeking <br />appellate review or relief, this determination shall be disclosed immediately following this closed <br />session. If the City Council authorizes initiation or intervention, such authorization shall be <br />disclosed immediately following this closed session and the public advised that the action, <br />defendants and other particulars may be disclosed upon request after the action is formally <br />commenced. (Gov't. Code §54957.1(a)(2)]. If the City Council renders the agreement final, they <br />shall report that approval and the substance of the agreement in open session at the public <br />meeting during which the closed session is held. (Gov't Code § 54957.1 (1) (A)] <br />If the City Council accepts a settlement offer signed by the opposing party, the substance of the <br />settlement shall be disclosed immediately following this closed session. (Gov't. Code <br />§54957.1(a)(3)(A)]. If final approval rests with the other party to the negotiations, the City shall <br />disclose the fact of that approval and the substance of the agreement upon inquiry by any <br />person, as soon as the other party or its agent has informed the City of its approval.
