�•� MEMORANDUM FROM THE CITY ATTORNEY / AGENCY GENERAL COUNSEL CONCERNING A CLOSED SESSION BEFORE THE CITY COUNCIL OF THE CITY OF REDWOOD CITY AND THE CITY OF REDWOOD CITY REDEVELOPMENT AGENCY TO: Honorable Mayor, Members of the City Council and Members of the Agency Board FROM: Stan T. Yamamoto, City Attorney / Agency General Counsel SUBJECT: Closed Session — Existing Litigation (Government Code §54956.9] Case Names: Wilson & Wilson v. Council, Cityand RedevelopmentAgencyof Redwood City (case nos. 418250, 429131) A closed session will be held on May 24, 2004, for the purpose of conferring with and/or receiving advice from your legal counsel concerning existing litigation which has been formally initiated to which the Council, City and Redevelopment Agency are parties. (GovY. Code §54956.9(a)] The City Attorney / Agency General will provide you with a status report on these particular cases. If the City Council / Agency Board authorizes the City Attorney / Generai Counsel to defend, or seek or refrain from seeking appellate review or relief, this determination shall be disclosed immediately following this closed session. If the City Council / Agency Board authorizes initiation or intervention, such authorization shall be disclosed immediately following this closed session and the public advised that the action, defendants and other particulars may be disclosed upon request after the action is formally commenced. (GovY. Code §54957.1(a)(2)]. If the City Council / Agency Board accepts a settlement offer signed by the opposing party, the substance of the settlement shall be disclosed immediately following this closed session. (GovY.
