U-z <br /> well as with the City Attorney's office. <br /> Planning Commission Review and Recommendation <br /> On December 16, 2003, the Planning Commission reviewed the proposed amendments, <br /> conducted a public hearing, and unanimously recommended the ordirances to the City <br /> Counc.�l for approval, with two exceptions. The Commission directed ihat staff make a <br /> minor �ording change in Section 33.8 regarding "abandonment of use° and revise the <br /> provisions of Section 33.16(a) regarding "nonconfortning parking — single family residential" <br /> for further Commission review. On January 20, 2004, the Commission unanimously <br /> approved the revised language for those two sections and forwarded the ordinance <br /> amendments to the City Council. <br /> Nonconforminq parkinq issue: <br /> The only extensive discussion by the Commission related to the nonconforming parking <br /> provisions for single-family residences (Section 33.16(a)). The initial draft ordinance limited <br /> additions to homes with inadequate parking to a maximum size of three bedrooms and <br /> 2,000 square feet. The Commission feit that homeowners who wanted to expand in excess <br /> of 2,000 square feet should be allowed to add on so long as the enlargements would not <br /> add bedrooms, but instead were intended for kitchens, bathrooms, and storage type areas. <br /> A conditional use permit process was added to that section to allow consideration of those <br /> additions with further protections as well, such as limiting the additions to no more than 200 <br /> square feet (or an additional 10% of the allowable square footage) over the lifetime nf the <br /> project. <br /> There were no public comments regarding the ordinances at either Planning Commission <br /> public hearings. <br /> The Planning Commission minutes are attached to provide further background on the <br /> Commission discussion on the ordinance amendments. <br /> Proposed Ordinance Revisions <br /> Attached is the draft ordinance amending the Zoning Code to provide fora) nonconforming <br /> lots, b) nonconforming uses, c) nonconforming structures, and d) nonconforming parking. <br /> Attached to this staff report are summary tables comparing the proposed changes to <br /> existing Zoning Ordinance provisions. The December 16, 2003 and January 20, 2004 <br /> Planning Commission staff reports include substantial background and details of the key <br /> provisions of the amendments. Also attached to the Commission staff report is a summary <br /> outline forthe amendments. The outline includes: identification of relevant Code sections; <br /> a statement of noted problems and intended purposes for the amendments; and a review <br /> of how zoning regulations in a variety of other cities address nonconforming lots, uses, <br /> structures and parkirg. <br /> Alternatives <br /> 1. Approve the ordinance amendments as proposed. <br /> 2. Modify the amendmenYs to address concerns raised by the City Council. <br /> 3. Refer one or more provisions of the amendments back to the Planning Commission for <br />
