8 . . Attachment 3.
REDWOOD CITY
PLANNING COMMISSION STAFF REPORT
DATE: January 20, 2004 AGENDA ITEM: 4
FILE: ZT 2003-07
PLANNER: Charles Jany, Principal Planner
Curtis Williams, Contract Planner
APPLICANT: CITY OF REDWOOD CITY
LOCATION: Citywide
PROJECT DESCRIPTION: Review of proposed modifications to Zoning
Ordinance Text Amendments relating to Nonconforming Parking and Uses
(continued item from Planning Commission meeting of December 16, 2003).
STAFF RECOMMENDATION: Review the revised language relating to
Nonconforming Parking for Single-Family Residential (Section 33.16(a)(7)) and
to Abandonment of Use (Section 33.8 a, b, c) and find that the proposed
modifications conform to the General Plan, are in the public interest, and
recommend approval of the subject Text Amendments to the City Council.
PUBLIC HEARING: Closed on 12.16.03 NO. OF NOTICES MAILED: NA
BACKGROUND:
At their regular meeting of December 16, 2003, the Planning Commission
reviewed various Zoning Text Amendments relating to nonconforming lots, uses,
structures, and parking. These proposed changes consisted of a complete
rewrite of Chapter 33 of the current Zoning Ordinance as well as modifications to
other applicable sections. The Planning Commission reviewed and took action to
recommend approval of all but the following two sections:
1. Section 33.8 "Abandonment of Use":
This section defines when a non-conforming use is considered "abandoned"
(and therefore cannot be re-established). The Planning Commission
requested that the word "consecutive" be inserted in appropriate portions of
Section 33.8 in order to cfarify that a nonconforming use will expire if and
when the applicable period lapses, as measured in consecutive days (or
months).
2. Section 33.16 a) "Non Conforming Parking — Single Family Residential"
