g . 6 -3
GENERAL PLAN CONFORMANCE
The proposed Zoning Ordinance amendments are consistent with General Plan
land uses and policies. The proposed cha:ges generaliy only allow continued
nonconforming uses that are legally establis`+ed and that have little impact on
neighboring properties. Expansion of noncontnrming uses and enlargement of
nonconforming structures is restricted in ways to assure incremental
improvements in compliance with the General Plan and the Zoning Ordinance.
These new regulations update sections of our Zoning Code which are unclear
and confusing; therefore, these amendments are determined to be in the public
interest.
ENVIRONMENTAL DETERMINATION
State Guidelines for the California Environmental Quality Act (CEQA) provide a
Categorical Exemption (Class 5, Section 15305 of the Guidelines) for:
"minor alterations to land use limitations...that do not result in changes in
land use or density."
Staff believes that this provision is applicable to the ordinance amendments, as .
no changes in land use or density are proposed. The intent of the provisions is to
move incrementally closer to compliance with Zoning Ordinance criteria.
Staff therefore believes that no further environmental review is needed for the
proposed ordinance amendments.
CONCLUION
Staff believes that the proposed ordinance amendments are necessary to:
• Allow the continuation of legally established uses and structures where they
are not offensive to neighboring properties;
• Assure that properties become more conforming as prior uses are
abandoned or as rebuilding occurs;
• Provide flexibility, through the Use Permit process, to determine whether
some expansion or change of nanconforming uses and structures is
appropriate, given specific site circumstances; and
• Provide clarity for staff and applicants as to how nonconforming provisions
are to be applied.
Subsequent to Planning Commission action, the Commission recommendations
will be forwarded to the City Council for a public hearing and final action.
Curtis Williams/Charles Jany Michael Church
Contract PlannedPrincipal Planner Planning Director
