A lise Pernut <br /> process is provided to allow for certain expansions or changes to nonconformin� uses or <br /> scructui es. Routine repair and maintenance of nonconfomun� structures is pernutted, as is the <br /> replacement of certain damaged nonconfornung structures. However, the specific provisions <br /> or fne Article need to be modified to add or clanfy definirions, to address the use of <br /> non conforniin� lots, to further limit the extent of expansions of nonconforming structures, to <br /> address ho�� structures with nonconfornung parking are treated, and to clarify provisions for <br /> det°rmininQ the valuation level required to allow repairs to or restoration of nonconfornung <br /> �;ructures (or to delete such criteria). The current regulations also in some instances may <br /> discouraoe rehabilitarion of aging structures by restricting needed alterations. <br /> OrHE�i CiTCES: Most cities allow for continuation ofnonconforming uses and the cqnrinued <br /> use of nonconforming structures, but vary in terms of the extent of alterations or additions that <br /> :u perniitted in such cases, and sometimes provide for amortization (phased elimination) of <br /> ��onconforming uses and buildings over specified time frames. Virtually all ordinances allow <br /> rur routine maintenance and repair of nonconfornung structures (or structures housing <br /> nonconforming usesj, and generally allow for non-sti alterarions, so long as there is no <br /> increase in the nonconforming use or structure. Restoration of damaged or destroyed <br /> noncon torming buildings is usually pernntted up to a maacimum percentage of the replacement <br /> � alue. Most ordinances define "nonconforming uses," "nonconforming structures," and <br /> "sn alterations," but some go further to define "alterarion" or "repair" or other useful <br /> :em�s. <br />
