In total, all FAR bonuses and exemptions <br /> for a particular project when combined, may allow for additional floor area in the <br /> developn •ent equivalent to 2% of the total land area. The following amenities coulc` qualify <br /> for an FAFc exemption or FAR bonus: <br /> FAR Exemption: <br /> 1. Child Care Facilities <br /> 2. Independent Non-Profit Educational Facilities open to the Public <br /> FAR Bonus: <br /> 1. Open Space for Public Use and Enjoyment <br /> 2. Outdoor Recreation Facilities for Public Use and Enjoyment <br /> Staff drafted the ordinance for the Zoning Text Amendment under the direction of the <br /> Planning Commission at the meeting on February 10, 2004. It was staffs understanding <br /> that the Planning Commission's intention was to limit the total of all FAR bonuses and <br /> exemptions combined to 2%. Upon review of the language, staff felt that it might construe <br /> that a project could receive up to a 4% increase in FAR. Staff therefore recommends that <br /> the following additional language be incorporated into the ordinance to ensure that the 2% <br /> additional FAR limit is not exceeded: <br /> _„ D. Developments may receive both the Floor Area Ratio exemption of <br /> subsection B. above and the Floor Area Ratio bonus of subsection C. <br /> above, but in no case will the total Floor Area Ratio exemption and bonus <br /> exceed two percent (2%) Floor Area Ratio relative to the land area of a <br /> particular development. <br /> Please note that the above language was not part of the Planning Commission <br /> deliberations and was developed by staff following the meeting. At the hearing, the <br /> Planning Commission mentioned that due to the haste with which the recommended code <br /> was written during the course of the meeting, changes such as the proposal above, to <br /> ensure consistency and clarity with the Planning Commission's intentions, were <br /> foreseeable. <br /> As proposed, the exemption would be granted by the Planning Commission for projects <br /> with Planned Development Permit or Precise Plans. This would generally apply to new <br /> projects. The Zoning Administrator could grant exemptions through a Use Permit reviewfor <br /> smaller projects that do not require Planning Commission review. <br /> The following criteria are necessary for the project to be eligible for an FAR exemption or <br /> bonus: <br /> • The project site must be located in a commercial or industrial zoning district with an <br /> FAR limit (the downtown commercial zoning districts do not have FAR limits and <br /> � thus would not benefit from an exemption or bonus). <br />
