RESOLUTON APPROVIING AMENDMENT NO.2 TO THE SANITARY SEWERAGE TREATMEfo.¡T CAPACITY RIGHTS AND SERVICES (TOWN OF WOODSIDE) AGREEMENT TO PERMIT SERVICE TO 208 MIRAMONTES WHEREAS, on or about May 7, 1997, by Redwood City Resolution No. 13084, the Town of Woodside entered into an Agreement with the City of Redwood City to use Redwood City's sewer capacity for the development of the Woodside Town Center (the "Agreement"); and WHEREAS, on or about June 18, 2002, by Redwood City Resolution No.14448, Amendment No.1 was executed, which added two properties to the Agreement. WHEREAS, the Agreement limits the service area to the Downtown Area of the Town of Woodside and the area from Palm Circle Road to Godetia Drive, and from Canada Road to Gle'1crag Way;,and WHEREAS, the septic sewer system at the property located at 208 Miramontes Road in the Town of Woodside has failed; and WHEREAS, the San Mateo County Environmental Health Office has declared the above-described septic systems unusable and have requested that the property owner connect to the closest sewer system; and WHEREAS, the Town of Woodside and the property owners of the above- described properties have requested that the City of Redwood City agree to amend the Agreement to allow said real properties to utilize Redwood City's capacity rights and services; and WHEREAS, the Town of Woodside will pay Redwood City the metered costs for sewage transmission, treatment and capacity rental, as established by the previous Agreement. NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF REDWOOD CITY, AS FOLLOWS: 1. The City Manager is hereby authorized and directed to execute and file Amendment No.2 to the Sanitary Sewerage Treatment and Capacity Rights and Services (Town of Woodside) Agreement, a copy of which is attached hereto as Exhibit "A" and incorporated herein by reference.
