" ,. - <br /> 1.A - \ <br /> REPORT <br /> - To the Honorable Mayor and City Council <br /> From the City Manager <br /> EXECUTIVE SUMMARY <br /> May 10, 2004 <br /> Subject <br /> Appeal of the Zoning Administrator's approval of a Planned Development Amendment at 2 <br /> Dillon Lane to allow for a second story balcony addition to an existing two-story single- <br /> family residence located in the Valota Place Planned Development. <br /> Recommendation <br /> Uphold the decision of the Zoning Administrator to approve the Planned Development <br /> Amendment. <br /> Background <br /> On March 22, 2004, the City Council held a public hearing to consider an appeal of the <br /> Zoning Administrator's decision to allow an amendment to the Planned Development <br /> Permit for 2 Dillon Lane allowing construction of a second story balcony addition to a two- <br /> ~' story single-family residence. At that meeting, the staff report was presented; the appellant <br /> was provided an opportunity to present arguments for granting the appeal; the applicant <br /> was provided an opportunity to present arguments for denial of the appeal; and members <br /> of the public were permitted to speak to the appeal. The City Council then closed the <br /> public hearing. Due to additional questions being asked by the City Council, the matter <br /> was continued for a period of not more than sixty (60) days to allow staff to (i) clarify the <br /> Zoning Code criteria which need to be met to render a decision on the appeal; and (ii) to <br /> locate the historical file on the Valota Place Planned Development Permit. <br /> Appellant's Issues: The appellant, lives at 6 Dillon Lane and seeks a reversal of the <br /> Zoning Administrator approval for the rear balcony addition at 2 Dillon Lane based on <br /> design compatibility issues and privacy concerns.
