The Environmental Assessment addressed potential environmental impacts of the <br /> '-- proposed 9 unit development. As part of the aesthetic analysis, the Initial Study discussed <br /> second story windows, privacy, and impacts to views. More specifically, the Initial Study <br /> states: <br /> The developer, at the request of the City, has agreed to minimize the <br /> invasion of privacy particularly for those homes beyond the creek on <br /> Goodwin Avenue. The applicant has agreed to eliminate the second story <br /> windows on lots 5 and 9 which face the creek. In their place will be some <br /> type of architectural feature and trim. .. This change including new fencing <br /> and landscaping should minimize the invasion of privacy for these existing <br /> homes. <br /> Mitigation Measure number 2 of the Mitigated Negative Declaration states, "that the <br /> applicant shall redesign the left elevation of Plan 2 on lots 5 and 9 so as to eliminate all <br /> second story windows. In their place shall be some type of architectural feature and trim. <br /> This design change shall be submitted and reviewed under the Architectural Permit." With <br /> this (and other) mitigation measure(s) in place Staff made the finding that "the project will <br /> not degrade the aesthetic quality of the area." <br /> Please note, this discussion refers to the 9-Unit proposal that had a different layout which <br /> included substantially smaller rear setbacks and which was not approved. <br /> ~ 2. At both the Planning Commission and City Council public hearings the issues of privacy <br /> and density were raised by concerned neighbors, the commissioners, and the council <br /> members and ultimately both the project and appeal were denied. (For further information <br /> the entire documents are available for viewing at the City Clerk's Office). <br /> 3. In 1997, when a revised 8-Unit project was resubmitted for Planning Commission <br /> consideration the Staff Report addressed privacy issues by reiterating the concerns ofthe <br /> previous plan and identifying how the revised 8-Unit plan sought to address these <br /> concerns. More specifically the staff report states, "The number of second story windows <br /> that look down on adjoining residences has been minimized. Also the developer has <br /> strategically located trees to help screen some of the homes, and has even offered to plant <br /> trees and construct an arbor on adjoining properties." <br /> Analysis <br /> The revised plans for the 8-unit project significantly reconfigured the layout of homes, <br /> thereby providing rear setbacks that are greater than what is required by the Zoning <br /> Ordinance in an effort to address privacy issues. As a result of the revisions incorporated <br /> into the "new" project, in 1997, staff made a positive recommendation and found that the <br /> project is "an attractive, high quality, infill residential development, keeping with the <br /> surrounding densities and residential types." <br /> The conditions associated with the project approval did not specifically reference any <br /> - privacy related issues, but they did require the construction of a seven foot high solid fence <br /> 5 <br />
