I ,. - l.A - 15 March 27, 2004 ',,-- TO: the Redwood City Council Members FROM: Miyo Nakanishi, member of the Valota Place Homeowners Assn RE: proposed balcony at 2 Dillon Lane Thank you for your consideration of the proposed balcony at 2 Dillon Lane. Again, I urge you to uphold the appeal to deny the proposed balcony. I realize you must make your decision within legal bounds. And the Planning Department was correct in approving the project. However, the initial HOA approval by our ex-president was not "legal," since at our first meeting almost five years ago, we elected three officers who became directors (please refer to the attachment), The directors must decide on any such project (as a balcony) which is otherwise forbidden according to our CC & Rs. Thus, the project would not have been approved by the Planning Department without an approval of our HOA. '- We all moved to Redwood City because of many reasons, one of which is its fine community relations. If you allow the balcony to be built, almost all of the surrounding homeowners will be dissatisfied and ill feelings will be fostered. The only two homeowners in favor are the Mervichs and Mr. Gershtein who made the initial error by signing off on the project without first consulting with our Board, Also, if this is aDowed, any homeowner in other associations could feasibly sign ofT on a project that might otherwise be voted down by the entire association. I am confident that you will not aDow this to happen.
