. <br /> g. �I - ��j <br /> payment will be determined each year in accordance with the provisions <br /> of the Cost Allocation and Budget Setting Methodology set forth in <br /> Attachment Nine. <br /> 8.0 TERM AND TERMINATION <br /> 8.1 Term <br /> The term of this Agreement will commence on the Effective Date, will extend at a <br /> minimum for the term of revenue bonds issued by City to finance construction of <br /> the Project, and will thereafter continue until terminated. <br /> 8.2 Termination <br /> This Agreement may be terminated with the written consent of both Parties. <br /> 9.0 OTHER AGREEMENTS <br /> 9.1 Delivery of Recvcled Water to Third Parties <br /> City may deliver Recycled Water produced by SBSA under this Agreement to <br /> third parties located outside City's boundaries, including other members of SBSA, <br /> on terms mutually satisfactory to City and such third party. If any additional <br /> regulatory approvals are needed to authorize such deliveries, City shall be solely <br /> responsible for the costs thereof. If a joint application is required, SBSA will <br /> cooperate with City, and City will reimburse SBSA for any costs incurred by <br /> SBSA in participating in the regulatory approval process. SBSA will not deliver <br /> Recycled Water produced at the Treatment Plant to any person or entity other <br /> than City, if doing so would interfere with, or increase the cost of, SBSA's <br /> delivery of Recycled Water to City pursuant to this Agreement. In addition, if <br /> delivery of Recycled Water to any third party would involve use of any SBSA <br /> owned facilities which have been purchased or improved with funds provided by <br /> -19- 1091374.7 <br />
