�•f�i-aq <br /> concems SBSA's failure to furnish Recycled Water in the quantities, of <br /> the quality, or at the times required by this Agreement, which failure <br /> occurs during the period from April 1 through October 1 of any year. In <br /> the case of a dispute described in the immediately preceding sentence, <br /> City may proceed immediately to seek a judicial decision and remedy. <br /> 9.7.3 Mana�ement Level <br /> SBSA's Manager and City's City Manager (collectively, "the Managers"), <br /> or their designees empowered to act on behalf of the Managers, will meet <br /> within two (2) weeks after receiving notice of the dispute from either Party <br /> to review, discuss and attempt to resolve the dispute. If the dispute is <br /> resolved by the Managers, the resolution will be reported to the governing <br /> bodies of the Parties, but no action will be required of these bodies. If the <br /> dispute is not resolved within four (4) weeks of receipt of the notification <br /> of dispute, then the Parties will proceed as described in Section 9.7.4. <br /> 9.7.4 Board Level <br /> If the Managers and/or their designees are unable to resolve a dispute, <br /> either official may deliver to the other a written request for the <br /> appointment of dispute resolution subcommittees. The request will be <br /> presented to City's Mayor and the Chairperson of SBSA's Commission <br /> within thirty (30) days after delivery of the request. Within thirty (30) <br /> days of receipt of the request, the Mayor and Chairperson (or the <br /> governing body of each agency) will appoint two (2) members to its <br /> dispute resolution subcommittee.
