$• 13i - 5B' <br /> SOUTH BAYSIDE SYSTEM AUTHORITY <br /> Redwood City, California <br /> LEASE AGREEMENT <br /> RECYCLED WATER TREATMENT/STORAGE/PUMPING FACILITY SITE <br /> THIS LEASE AGREEMENT ("Lease"), dated for convenience as of <br /> August 1, 2004, is made and entered into by and between the SOUTH BAYSIDE <br /> SYSTEM AUTHORITY, a public agency of the State of Califomia, ("Lessor"), <br /> and the City of Redwood City, a municipal corporation in the State of California, <br /> ("Lessee"); <br /> WITNESSETH: <br /> Lessor and Lessee are concurrently parties to the Agreement for <br /> Production and Delivery of Recycled Water, dated as of August 1, 2004, and <br /> incorporated herein by reference ("Agreement"). <br /> Lessor, for and in consideration of the rental payments provided for herein <br /> and of the mutual agreements, terms, covenants, and conditions herein <br /> contained, does hereby lease, let, and demise to Lessee, and Lessee does <br /> hereby lease, hire, and take from Lessor, the real property more particularly <br /> described on Exhibit "A" and depicted on Exhibit "B" hereof, attached hereto and <br /> by this reference incorporated herein. Lessor further grants Lessee for the term <br /> of the Lease Agreement non-exclusive easements for ingress, egress and <br /> utilities in and over the areas described and depicted on Exhibits "C-1, C-2, C-3 <br /> and C-4", attached hereto and incorporated by this reference. <br /> 1. TERM. This Lease shall commence on January 1, 2006, and shall <br /> end on December 31, 2056 (the "Term"), unless earlier terminated.
