That the City Council adopt the attached resolution authorizing the City Clerk or <br /> his/her designee to accept real property deeds, grants and easements on behalf of <br /> the City. <br /> 2. That the Redevelopment Agency adopt the attached resolution authorizing the <br /> Agency Secretary or his/her designee to accept real property deeds, grants and <br /> easements on behalf of the Redevelopment Agency. <br /> Background <br /> Prior to allowing the recordation of a deed, grant or easement that conveys an interest in <br /> real property to a public entity, the County Recorder must ensure that the interest has been <br /> formally accepted by the public entity. State law authorizes political corporations and <br /> governmental agencies to authorize, by a general resolution, one or more officers or <br /> agents to accept grants, deeds or easements. <br /> In 1988, the City Council adopted Resolution No. 10944 which authorized the then City <br /> Clerk, Arlyn Jorgensen, to accept grants or deeds on behalf of the City. A search of <br /> Redevelopment Agency records did not reveal a similar resolution authorizing the Agency <br /> Secretary to accept such interests on behalf of the Agency. As Ms, Jorgensen no longer <br /> serves as the City Clerk; the City no longer has in place a general resolution authorizing an <br /> officer or agent to accept grants or deeds on behalf of the City. <br /> Th is matter was recently brought to the attention of the City Attorney's Office and therefore <br /> subsequent staff reports that involved real property deeds have specifically authorized the <br /> current City Clerk to accept a particular deed on the City's behalf. <br /> Similar to Resolution 10944, the attached resolutions authorize the City Clerk and Agency <br /> Secretary to accept grants, deeds and easements on behalf of their respective entities. <br /> Unlike Resolution 10944, the attached resolutions do not name a specific individual and <br /> instead specifies a particular officer -- the City Clerk and/or Redevelopment Agency <br /> Secretary (or their designee) as being authorized to accept grants, deeds and easements. <br /> Atty/AgendaReports/Certificate of Acceptance � <br />
