V/ '� 1 ' <br /> Under this Order, the developers of commercial, industrial, or residential projects that create <br /> more than one (1) acre of impervious service are required to install permanent treatment <br /> measures to control stormwater runoff. Developers have a menu of treatrnent measures to <br /> choose from, based on the type and style of the project (e.g., high density versus open <br /> space-type development). The Order also requires that, as of July 1, 2004, all municipalities <br /> impose on developers, the requirement to enter into an agreement to operate and maintain <br /> permanent treatment measures. <br /> Exempt from the Order are single family homes, which are not part of a larger common plan <br /> of development, and construction of streets, roads, and other similar maintenance projects. <br /> The new Ordinance is summarized in the attached Executive Summary. <br /> Council has already approved the new San Mateo Countywide Stormwater Management <br /> Plan for the period of July 2004 through June 2009. Information on the NPDES permit re- <br /> issuance is available on file in the City Clerk's Office and can be viewed online at the <br /> Countywide STOPPP website: www.flowstobav.ora). Page ES-5 of the Executive Summary <br /> contains an explanation of the changes in the new plan, which is different from the previous <br /> Stormwater Management Plan. <br /> Alternative <br /> The City must comply with the regulations and statutes governing municipal stormwater <br /> pollution prevention and water quality standards as established by federal and State law. <br /> There is no practical alternative to meet this mandate. <br /> Fiscal Impact <br /> The implementation of the Order will certainly involve more staff time, particularly from <br /> Community Development Services Department. The actual cost impact is yet to be <br /> determined, as the first projects to be affected by this Ordinance will be Abbott Labs and <br /> Marina Shores Village. Staff will be looking for ways to identify these added costs, and <br /> perhaps we will be coming back to Council with a proposed fee structure to support the cost. <br /> � <br /> Jon K.
