II . <br /> (P.I C"I <br /> '~ <br /> April 12,2004 <br /> Subject <br /> Grant of Revocable Encroachment Permit to the Redwood City School District (District) <br /> for the Placement and Operation of a Maintenance, Operation and Transportation <br /> (MOT) Storage Building at the McKinley Institute of Technology, located at 400 Duane <br /> Street, Redwood City. <br /> Recommendation <br /> Approve and authorize execution of the Grant of Revocable Encroachment Permit for <br /> the placement and operation of Redwood City School District's storage building on the <br /> public right-of-way. <br /> Background <br /> The Redwood City School District plans to build a storage building at the McKinley <br /> Institute of Technology (McKinley School), located at 400 Duane Street, Redwood City. <br /> , A major part of this new storage building and its proposed handicap parking space is to <br /> - be located on a perceived District-owned, vacant lot adjacent to McKinley School at the <br /> corner of Harrison Avenue and Fulton Street. <br /> During the building permit plan review process, City and School District staff realized <br /> that the above vacant lot was no longer owned by the School District. Since its <br /> dedication in 1930, this lot has become a public lot with the intended use as a public <br /> street. Although a street was never built, and will not likely be built, the lot is being <br /> used by a residential lot at 601 Harrison Avenue, as their only means of access to a <br /> public street. <br /> The School District has requested the City grant a revocable encroachment permit for <br /> the placement of the abovementioned storage building on the northern half of the lot. <br /> Staff has reviewed the request along with the construction plans. Staff recommends <br /> that a revocable encroachment permit be granted to the School District, since there is <br /> no plan to build a public street in this area, and a large part of the lot was originally <br /> dedicated to the City by the School District with a condition that it be returned to the <br /> School District, if it is not used as a public street. The permit will legally address both <br /> the needs of the Public, as well as the needs of the School District. <br /> The Permit will allow the School District to construct, operate, maintain, and replace the <br /> I District-owned storage building within the public right-of-way. The District is <br /> '-, responsible for all construction, maintenance, and replacement costs for this building. <br /> Page 1 of 2 <br />
