<br /> 1.A~ <br /> SECOND AMENDMENT TO <br /> THE AGREEMENT FOR saUD WASTE, RECYCLABLE MA TERIAI.5, AND PLANT <br /> MATERlAI.5 COLLECTION SERVICFS <br /> THIS SECOND AMENDMENT t" the Agreement for Solid Waste, Recyclable M'lterials, <br /> and Plant Materials Collection Services ("Agreement"), is made and entered into as of the <br /> - day of . 2004, by and between the City of Redwood City (" Agency"),a <br /> charter city and mUIÚcipal corporation of the State of California, and BFI WASTE SYSTEMS OF <br /> NORTH AMERICA, Inc. ("Contractor") of San Mateo. <br /> RECIT AI.5 <br /> Whereas, Agency and Contractor entered into the Agreement, dated September 9, 1999 <br /> and effective January 1, 2000; and <br /> Whereas, on June 12, 2000, the City Council adopted an amendment to the Agreement <br /> (the "First Amendment") to expand the collection of plant materials to include service to non- <br /> residential properties; and <br /> Whereas, the Agreement anticipates that the Agency may request additional services or <br /> the modification of existing services there under; and <br /> Whereas, the Agreement provides that Agency may direct Contractor to submit <br /> proposals from time to time to provide additional or expanded services; and <br /> Whereas, the Agency is a Member Agency of the South Bayside Waste Management <br /> Authority ("Authority"), and the Authority, on behalf of Agency, has requested a proposal from <br /> Contractor for a Commercial Organics Collection Program; and <br /> Whereas, Contractor has prepared a proposal in response to the Authority's request; and <br /> Whereas, Contractor and Agency now desire to amend the Agreement to incorporate the <br /> Commercial Organics Collection Program. <br /> NOW, THEREFORE, IT IS AGREED AS FOLLOWS: <br /> 1. Contractor shall implement the program to diverted commercial organic material <br /> from landfill disposal (hereinafter the "Commercial Organics Collection Program") consistent <br /> with Contractor's November 20, 2002 proposal (Attachment 1), and subsequent clarifications <br /> and revisions dated: January 27, 2003 (Attachment 2); February 7, 2003 (Attachment 3); March <br /> 14, 2003 (Attachment 4); August 6, 2003 (Attachment 5); and August 13, 2003 (Attachment 6). <br /> Copies of the foregoing documents are on file with the Authority, the City Clerk of the Agency, <br /> and the Contractor. <br /> 2. The Commercial Organics Collection Program shall commence not later than <br /> October 1, 2004, and shall continue for the remaining term of the Agreement and any extension <br /> thereof. <br /> Atty/ Agr/ Amendment 2 - 8FI <br /> 040104 1 <br />
