<br />ATTACHMENi :t1 B <br />Page 5 <br /> <br />Consumers All Items, 1982-1984 = 100 for the San Francisco - Oakland - San Jose - <br /> <br />CMSA, published by the United Department of Labor, Bureau of Labor Statistics (the <br /> <br />"Index"). The difference between the Index which is in effect on the date immediately <br /> <br />prior to the commencement of each Lease Year (the "Beginning Index") and the fudex in <br /> <br />effect immediately prior to the commencement of the following Lease Year (the <br /> <br />"Extension Index") is to be used in determining the amount of the adjustment. If the <br /> <br />Extension Index has increased over the Beginning Index, the minimum rent for each <br /> <br />Lease Year ("L Y") shall be set by multiplying the rent in effect during the previous L Y <br /> <br />by a fraction, the numerator of which is the Extended Index and the denominator of <br /> <br />which is the Beginning Index. For Example, the rent for L Y7 shall be determined as <br /> <br />follows: <br /> <br />L Y6 rent X Index in effect on last day Drior to commencement oil Y7 _= Rent for L Y7 <br />Index in effect day prior to commencement of L Y6 <br /> <br />And for L Y8: <br /> <br />L Y7 rent X Index in effect on last day prior to commencement of L Y8 = Rent for L Y 8 <br />Index in effect on day prior to commencement of L Y7 <br /> <br />provided that the rent for any of the four L Y (L Y7 through L YI 0) shall not be increased <br /> <br />by more than four (4) percent per L Y over the rent in effect during the preceding L Y. In <br /> <br />no case shall the rent during any L Y be less than the rent in effect immediately prior to a <br /> <br />rent adjustment date. <br /> <br />Lessor shall notify Lessee of such adjustment by delivering or mailing a written <br /> <br />statement setting forth the calculation of the adjustment in rent. If the format or <br /> <br />components of the Index shall be changed materially, or if the Index shall be <br /> <br />discontinued after the date of this Lease, then Lessor shall substitute a type of index <br /> <br />which is published by the U.S. Department of Labor, the Bureau of Labor Statistics or <br /> <br />LeaseAgreemellt-COUlnlUllicatiollsSite - 02102/06 <br /> <br />SITE #599A <br /> <br />3 <br />
