<br />ATTACHMEtD.~ B <br />Page 7 <br /> <br />improvement, repair, maintenance and use of the improvements, equipment and facilities <br /> <br />on the Leased Premises. <br /> <br />Lessor grants Lessee reasonable vehicular and foot access to and around the <br /> <br />Leased Premises without notice to Lessor. Said access shall be available twenty-four (24) <br /> <br />hours a day, seven (7) days a week, and shall be at no charge to Lessee, by means of <br /> <br />California Way, and the existing gates and roads across the Emerald Lake Hills Water <br /> <br />Tank Property to the Leased Premises (the "Access Areas"). <br /> <br />4.02 Prohibited Uses. Lessee shall not use the Leased Premises for any <br /> <br />purpose not expressly permitted hereunder. Lessee shall not (a) create, cause, maintain or <br /> <br />permit any nuisance in, on or about the Leased Premises or permit or suffer the Leased <br /> <br />Premises to be used for any unlawful or inunoral purpose, or (b) do or permit to be done <br /> <br />anything in any manner which unreasonably disturbs the occupants of neighboring <br /> <br />property, or (c) interfere with or disturb in any way 1) the operation of Lessor's system or <br /> <br />tank site about the Leased Premises, 2) radio communication system linked to telemetry <br /> <br />controls at various tank and pumping facilities, 3) any future facilities or operations that <br /> <br />may be implemented by Lessor. In the event that Lessee causes any disturbance and/or <br /> <br />interference prohibited by this Paragraph and it is not promptly resolved, this Lease shall <br /> <br />thereupon tenninate upon written notice by Lessor. <br /> <br />4.03 Approval by the City and Other Agencies. As a condition precedent to <br /> <br />Lessor's obligation to tender the Leased Premises to Lessee, Lessee shall obtain the prior <br /> <br />approval of the City of Redwood City and such other governmental agencies and bodies <br /> <br />that may have jurisdiction over the use of the Leased Premises by Lessee to make the <br /> <br />improvements specified in Paragraph 4.01 and to conduct the activities permitted under <br /> <br />LeaseAgreement-CommunicationsSite - 02/02/06 <br /> <br />SITE #599A <br /> <br />5 <br />
