Adequate <br /> money will be held in retention to insure that all work gets completed (Section <br /> 3.H.3.). <br /> ➢ Removed language relating to strikes, lockouts, and _�ther labor disputes wit; �in <br /> the schedule (Section B.C.). - <br /> ➢ Changed the requirement for Builder's Risk Insurance from the Developer to <br /> the General Contractor, who is able to get this type of insurance. The <br /> deductible amount is also changed to conform to industry standards (Section <br /> 13. B.7.). <br /> Preliminary soil and groundwater testing has been performed on portions of the site, but <br /> not to the extent necessary to start excavation. The Developer has hired a company to <br /> do this testing, and the results will be available the week of October 13, 2003. We are <br /> not anticipating any unusual contamination on the site, but if something should turn up, <br /> we will be back to the Council/Agency for appropriate action. The costs associated <br /> with soil and groundwater clean-up will be paid by the City. <br /> The current cost estimate does not include the "supergraphics" that have been <br /> discussed at some of the meetings. There is adequate time to get designs and cost <br /> estimates prior to completion of the garage. As we get further along in the project, we <br /> will have a better understanding of all construction costs and can look into upgrades, if <br /> warranted. <br /> Because this project is on such a tight schedule, we do not have final plans or hard <br /> bids on many of the trades. Some of the bids received so far are nearly the same as <br /> the estimates from the General Contractor, which is a good sign. <br /> Alternatives <br /> Leave the Agreement in the form approved on September 22, 2003, which could cause <br /> substantial delays. The new language provides City staff clearer direction for <br /> administering the contract. These changes do not cause a delay or increase cost or <br /> City risk for the parking garage. <br /> Fiscal Impacts <br /> These changes to the Agreement do not add any cost to the parking garage, but should <br /> clarify who is responsible for unforeseen costs. <br /> , �� <br /> i.
