<br /> Developer and City agree upon, prior to the commencement of excavation, or construction in
<br /> connection with the Project, to fumish to City and Agency, and file with the City Clerk and Agency
<br /> Secretary, a bond or instrument of credit of the kind described in Section 66499, et seq. of the
<br /> Califomia Government Code, securing the faithful performance of the Contractor's obligations
<br /> under this Agreement within the time herein specified, which bond or instrument of credit shall be in
<br /> an amount determined by the City and Agency. Developer shall likewise cause each and every
<br /> I Contractor performing dewatering, shoring,piling, structurel concrete, wate roofin , lumbing,_fire ,.--'� De1e0e° �

<br /> protection, HVAC, or electrical work in connection with the Project, and any other contractors that
<br /> the Developer and City agree upon, prior to the commencement of excavation or construction in
<br /> connection with the Project, to furnish and file with the City Clerk and Agency Secretary a bond,
<br /> deposit, or instrument of credit of the kind described in Sections 66499 et seq. of the California
<br /> Government Code securing the payment by Contractor for labor, materials, equipment or services
<br /> furnished in connection with the Project and the doing of all other work herein agreed to be done by
<br /> Developer. The amount of the security shall be One Hundred Percent (100%) of the value of the
<br /> Contractor's contract for the Project. The security shall include, in addition to the principal
<br /> amounts, a guarantee of the payment of costs and reasonable expenses and fees, including
<br /> reasonable attorneys' fees, incurred by City and/or Agency in the event of successful enforcement
<br /> of such security. All bonds shall be issued by a corporate surety admitted in the State of Califomia
