<br /> (Ó.3A, I <br /> REPORT <br /> To the Honorable Mayor and City Council <br /> From the City Manager <br /> November 8, 2004 <br /> Subject <br /> Resolution to approve the creation of a Relocation Appeals Board for City and <br /> Redevelopment Agency and approving membership of said Board <br /> Recommendation <br /> Adopt a resolution creating an Agency/City Relocation Appeals Board pursuant to Section <br /> 204 of the Redwood City Redevelopment Agency Rules and Regulations for the <br /> Implementation of the California Relocation Assistance Law and Property Acquisition <br /> Procedures ("Agency Relocation Rules) and the State of California Relocation Guidelines <br /> ("State Guidelines") and approving the appointment of Relocation Appeals Board <br /> members. <br /> Background <br /> The Agency Relocation Rules adopted on January 25, 1999, allow for a Relocation <br /> Appeals Board to be created for the purpose of hearing relocation matters that are in <br /> dispute. These procedures state that the Appeals Board shall be comprised of five <br /> members appointed by the Mayor, subject to the approval of the City Council. The City <br /> does not have separate procedures for business relocation issues and thus follows the <br /> State procedures. Section 6158 of the State Guidelines requires that formal review of a <br /> relocation decision be conducted by the head of the public entity or an authorized impartial <br /> designee. Further, the State Guidelines allow the designee to be a committee. For <br /> consistency between City and Agency procedures, it was felt that the use of the same <br /> Relocation Appeals Board would be appropriate. <br /> As it is likely that a Relocation Appeals Board will meet on a very infrequent basis, the <br /> Mayor has proposed that the Appeals Board consist of the chairpersons of the following <br /> five (5) City bodies: <br /> · Planning Commission <br /> · Architectural Review Committee <br /> · Historic Resources Advisory Board <br /> · Board of Building Review <br /> · Housing and Human Concerns Commission <br /> In a chairperson's absence, the particular body's vice chairperson would serve as the <br /> Relocation Appeals Board member. <br /> 11/2/2004 Page 1 of 2 <br /> _.
