~-:3 A- /

REPORT

To the Honorable Mayor and City Council
From the Ci Mana er

May 23,2005

Subject
Final Acceptance - Electronic Arts, Public Improvements.

Recommendation
Accept, by Minute Order, the Public Improvements for Electronic Arts (201 Redwood
Shores Parkway), and release the bonds following the submission of a Maintenance
Bond in the amount of $12,000 (10% of the original bond), in accordance with the
Improvement Agreement.

Background
On September 8, 1997, the City Council approved the Agreement for the improvements
related to the Electronic Arts building located at 201 Redwood Shores Parkway. The
public improvements included street work associated with the entrance to their building,
including curbs, gutters, sidewalks, traffic signal modifications, street lighting,
landscaping, and miscellaneous related work.

The construction of the improvements were completed some time ago, except for one
lingering issue that related to the cleaning of the storm drainage system downstream
from their site. The City staff has been working with various contractors to find a way of
cleaning these systems. The storm drains in that area (like all of Redwood Shores) are a
"wet' system, in that they are continually submerged due to the high water level in the
lagoon system. After several failed attempts by maintenance crews to find an easy way
of cleaning these pipes, we have determined that the methods available would be
beyond the expectations of a private business owner to undertake. The City
maintenance crews will have to take this task on themselves, and over a long period of
time, schedule the cleanup of the whole storm drainage system.

The property owner (Flatirons Funding Limited Partnership) provided a Faithful
Performance Bond and a Labor & Materials Bond in the amount of $120,000 for this
project, which can now be released,

Alternative .- --r~-'
The alternative is to not accept the improvements, which would be contrary tò prior
Council action.
