<br />.. <br /> <br />Morgan Marchbanks, Principal of Sequoia High School, represented the student <br />body of Sequoia High School who attend, go to and walk from a school in the <br />neighborhood which has the rarely found neighbor of an adult store. She stated <br />that a special permit was required for this business to operate this close to their <br />place of learning not only academics but socially appropriate behavior. Further <br />concerns were that Sequoia will be operating all summer long, 8th graders will be <br />attending and some students, under age or still dependent on their parents, have <br />accessed the store. She urged the Council to not extend the permit. <br /> <br />Raymond Denardi, property owner of 739 EI Camino Real, stated that there is 6 <br />months left on the lease and his question is who will pay for it. He stated that the <br />business has been there for 30 years and that all of the merchandise in the store <br />can be purchased on the internet. <br /> <br />Frank Romero thanked the Council and staff stated that he is the supervisor of <br />the book store. He stated that in the 5 years he has had the responsibility to <br />pursue alternate locations that the company had paid for an extensive study to <br />determine possible locations and he had investigated those sites. He stated that <br />Bay Management has been responsible at the store for 20 years, that there are <br />strict requirements that do not allow minor entry, and security systems to ensure <br />safety. <br /> <br />Council questions ensued about the responsible party should the lease be <br />broken and clarification of the findings requirement. An explanation of the <br />improvements to the property was requested. <br /> <br />In making the motion, Council Member Hartnett stated that he does not wish the <br />use there any longer. However, by not granting the extension, there would be <br />litigation, the use would exist during that period of time and it would place the <br />City in a more difficult situation come the expiration of the lease and the <br />amortization period to defend our actions. <br /> <br />Recommendation: <br />MIS Hartnett/Foust to adopt the attached resolution granting a six-month <br />extension to continue the non-conforming use at 739 EI Camino Real (Secrets <br />Adult Boutique) until January 12, 2006. For clarification, the resolution will <br />include a revision to Page 2, Section 2, first sentence: "... this Council hereby <br />approves a one-time extension...
