~/F",z

inquired if they would be interested in receiving a Request for Proposals (RFP) for the
Toilet Replacement Program. In February, 20 interested companies received RFPs, of
which three submitted detailed proposals. A selection team of City staff, and two City-
retained, independent consultants reviewed and rated proposals. It was determined that
two of the companies with substantial toilet replacement experience were highly qualified
and could perform the project. San Jose Water Conservation Corp. was ranked first at that
stage. Interviews of the two companies were conducted on April 21, 2005, utilizing the
same selection team. San Jose Water Conservation Corp. was ranked first at the
conclusion of that process as well.

The agreement's scope of services, staffing plan and project schedule have been modified
slightly during the intervening contract negotiations between San Jose Water Conservation
Corp. and staff. Should the City Council authorize the Agreement, the project will
commence on June 6, 2005 and be completed before June 6, 2008 at a not-to-exceed cost
of $2,200,000. The program's budget includes the cost of toilet fixtures and materials,
installation and a one year installation guarantee by contractor. The City's total estimated
number of toilets replaced under this agreement will be 10,050 as delineated in Exhibit 'A'
of the Agreement.

Alternative
Do not authorize the agreement and give direction to staff.

Fiscal Impact
Funds for this program are available in the Water Enterprise Fund Capital Improvement

Manuel Rosas ' Ed veœtt
Public Works Superintendent Public Works Services Director City Manager

Attachments
1.
