6.3.E. - Page 1 <br />REPORT <br />To the Honorable Mayor and City Council <br />From the City Manager <br />July 11, 2011 <br />SUBJECT <br />Subject to Voter Approval, Amend Charter Section 3 Y2 and Add New Charter Section 3 <br />3/ <br />RECOMMENDATION <br />Adopt Resolution Submitting Certain Charter Amendments to the Voters at the <br />November 8, 2011 Election <br />BACKGROUND <br />During its June 27, 2011, meeting, the City Council authorized the Charter Ad Hoc <br />Committee and staff to prepare the documents necessary to place before the voters in <br />November, 2011, certain Charter amendments addressing acquisition and disposition of <br />property. <br />The proposed amendments would allow the City to have a greater voice in shaping the <br />disposition and development of its assets. Currently, Redwood City's Charter makes the <br />highest bid the sole factor in the sale of City property. However, most cities in California <br />are governed by general law. The general provides that a city may purchase, lease, <br />receive, hold, and enjoy real and personal property, and control and dispose of it for the <br />common benefit. (Cal. Gov't Code 37350) If the amendments to the Charter are <br />adopted, Redwood City would have the flexibility that most other cities have in <br />managing its property. <br />Currently Section 3 Y2 of the Charter applies to both to the City and to the Port but has <br />different rules for each. The proposed amendments would create clarity by separating <br />the rules that pertain to the City and those that pertain to the Port. Section 3 Y2 would <br />apply only to the City and would provide it with the same rights that apply to a majority <br />of cities in the state under California general law. A new Section 3 % applying only to <br />the Port would be added to maintain the requirements that have been applicable to the <br />Port under Charter Section 3 Y2. A minor revision is also proposed for Section 48a <br />relating primarily to Port leasing authority in order that the section properly cross - <br />references new Section 3 -3/4. <br />The Charter of Redwood City was adopted by the voters in 1929 and it has been <br />amended fifteen times since then, most recently in 2009. By adopting the attached <br />resolution, the City Council would be placing a ballot question before the voters in the <br />
