6.3.F. - Page 1 <br />REPORT <br />To the Honorable Mayor and City Council <br />From the City Manager <br />July 11, 2011 <br />SUBJECT <br />Subject to Voter Approval, Amend Section 32.75 of the Municipal Code Increasing Transient <br />Occupancy Tax from 10% to 12% <br />RECOMMENDATION <br />1. Adopt Resolution Submitting to the Voters at the November 8, 2011 Consolidated General <br />Election A Ballot Measure Increasing the Transient Occupancy Tax (TOT) from 10% to 12 %; <br />2. By motion authorize the Mayor and Vice Mayor to select such persons as necessary to sign <br />the ballot arguments in favor of the proposed ordinance amending the TOT. <br />BACKGROUND <br />The City Council adopted Resolution Number 15126 during the June 27, 2011, City Council <br />meeting submitting to the voters at the November 8, 2011 election, a ballot measure increasing <br />the TOT. Re- adoption of the resolution is being requested in order to account for a minor <br />amendment to the resolution clarifying that the full text of the ordinance will not be published in <br />the voters' pamphlet. Instead, the full text of the ordinance will be on -line and also available on <br />request through the Clerk's office. The ballot questions, the City Attorney's impartial analysis, <br />and arguments will continue to be published. This is consistent with past practice in recent years <br />and will decrease election costs. For the sake of historical clarity, the original resolution is being <br />rescinded and superseded by the present resolution. <br />ALTERNATIVES <br />1. Do not adopt the new resolution and instead include the full text of the proposed ordinance <br />in the voter pamphlet. <br />2. Do not proceed with a proposed increase in the TOT. <br />FISCAL IMPACT <br />At approximately $1,230 a page for publication in the voter pamphlet, the additional cost to <br />publish the full text of two ballot measures and a proposed charter amendment in the voter <br />pamphlet is somewhere between $6,150 and $11,070, depending on the County's font and <br />formatting. <br />PAMELA THOMPSON <br />CITY ATTORNEY <br />
