- I . k& <br />Legislative Bill Action <br />................................ ............................... <br />The following are summaries of just a few of the legislative bills that are currerAy being acted upon <br />by the League of California Cities. Financial Assistance. <br />Relocation of Vehicle Dealers and Big Box <br />Retailers. Local government agencies would be <br />prohibited from offering incentives to lure big box <br />retailers or vehicle dealers to their area from <br />another jurisdiction in their local market area. <br />Frequently, cities are placed in an awkward <br />situation when a large retailer comes calling with <br />an opportunity to generate large sales tax rev- <br />enues in exchange for special incentives to help <br />the retailer move from another local city or county. <br />SB 114 eliminates that situation. Staff: Jean <br />Korinke, Status: Governor's Desk, Position: <br />Request for Signature. <br />TRANSPORTATION, COMMUNICATIONS AND <br />PUBLIC WORKS <br />AB 1022 (Oropeza). Automated Enforce- <br />ment Systems. AB 1022 revises the red light <br />camera law by establishing guidelines for selec- <br />tion of a location, ensuring that the equipment is <br />regularly inspected and certifying that the equip- <br />ment is properly installed and functioning. Addi- <br />tionally, it allows local governments to contract out <br />technical activities relating to the operation of <br />automated systems. Finally it specifies that the <br />minimum yellow light change intervals relating to <br />designated approach speeds provided in the <br />Traffic Manual of the State Department of Trans- <br />portation are mandatory minimum yellow light <br />intervals. The interval may exceed the minimum. <br />AB 1022 as amended, will allow local govern- <br />ments the ability to place enforcement cameras <br />within their cities. This bill will afford local govern- <br />ments the flexibility needed to ensure public safety <br />by improving the operation of red light camera <br />systems, providing greater guidance and public <br />control over the systems' use. Furthermore, <br />these changes will improve motorists' confidence <br />in the camera systems and their use and result in <br />improved driver behavior and traffic safety. <br />Staff: Natasha Fooman, Status: Governor's <br />Desk, Position: Request for Signature. <br />AB 1625 (Benoit). Vehicles. Seat Belts. <br />Fines. AB 1625 could potentially increase state <br />and local revenue generated by penalty assess- <br />ments and surcharges added to the base fines for <br />seat belt use violations. AB 1625 increases the <br />maximum penalty fine for an initial penalty from <br />$22 to $65. It also increases the maximum penalty <br />for repeat violators of the seat belt law from $55 to <br />$140. Additionally the increase in fines could <br />potentially act as a deterrent for none seat belt <br />users. The bill passed out of Senate by a vote of <br />25 -12. Staff: Natasha Fooman, Status: In <br />Assembly for Concurrence; Position: Support. <br />SB 966 (Alarcon). Prevailing Wages on <br />Public Works. Contractor's Cost. SB 966 as <br />amended on August 26, still does not eliminate the <br />problem of the previous version of the bill. The bill <br />still makes the public agency liable when it does <br />not explicitly require the developer to pay prevailing <br />wages even though the public agency is unsure if <br />they are legally required. However, the impact of <br />that problem is lessened for redevelopment agen- <br />cies and therefore they have removed their opposi- <br />tion based on new amendments.
